 COMMON WAYS OF HOLDING TITLE-CALIFORNIA

SOLE OWNERSHIP

A Single Man or Woman, An Unmarried Man or Woman or a Widow or Widower.

A Married Man or Woman

 as His or Her Sole and Separate Property 

A Domestic Partner

 as His or Her Sole and Separate Property. 


CO-OWNERSHIP

More than one owner.

Community Property.

Property acquired by either spouse during a marriage is presumed to be equally owned by both spouses.  Ownership and managerial interests are equal (except control of business is solely with managing spouse)  

Community Property with Right of Survivorship.

Only Married Spouses

Joint Tenancy with right of survivorship.

 Any number of persons can be Married Spouses. 

 Ownership interest must be equal 

Tenancy in common.

 Any number of persons can be Married Spouses.  Ownership can be divided into any number of interests equal or unequal
